The H-1B Visa Application

Process is now open for 2024–2025.

H-1B Temporary (non-immigrant) visa permit. This allows USA-based employers to file petitions for highly educated foreign professionals to work in “specialty occupations” Applicant must hold a bachelor’s degree or higher degree. In particular, the foreign worker must be employed in a field where the employer is unable to obtain a US worker with the requisite specialized knowledge.

 The H1B petition is based on an offer of employment by a US employer to its employees. If the worker is an outsider of the United States, he should obtain an H1B visa. However, understanding the lottery and cap for H1B visas is of major importance before we take a look at who is eligible to get an H1B visa and how to apply.

Requirements to Apply

To be eligible in the category of specialty occupation for H1B visa 2024-25, a job must fulfill one of the following criteria:

  • The H-1B includes having a job offer from a U.S. employer and possessing the necessary qualifications and experience for the position
  • The eligible applicant must have applied the knowledge both theoretically and practically in specialized professions.
  • For professional occupations, a bachelor’s degree or higher or equivalent or accredited training program in the same field from an accredited college or university is required.
  • Must have a certificate of good character and a genuine intention to come to the United States to work.
  • Have a minimum of 4 to 5 years of professional experience in the particular occupation for which the candidate has applied.
  • Candidates must have in-depth knowledge of the required field.
  • Professional certifications in the occupational field are usually necessary.

H-1B Visa fee and Cost :

  • $10 registration fee.
  • Basic filing fee $460 (I-129).
  • USCIS anti-fraud fee $500.a
  • ACWIA Education and Training. -a. Employers with 25 or fewer employees – $750. -b. Employers with more than 25 employees – $1,500.
  • Premium Processing Fee is Optional $2500.

H1B Visa Caps

To be eligible in the category of specialty occupation for H1B visa 2024-25, a job must fulfill one of the following criteria:

  • 65,000 for the H1B regular pool.
  • 20,000 specifically for U.S. advanced degrees.

Important Dates for -H1B Visa Lottery

The registration process dates for a USA H1B Filing are as follows:

  • 1ST March 1– Employers must start creating an H1B registrant account at noon US Eastern time.
  • March 1 to March 18– H1B registration period. The registration period opens and closes at noon US Eastern time.
  • March 31– By this date, the USCIS will have notified the selected entrants.
  • April 1– if your employer’s petition was selected, this is the earliest date that you may submit an application for an H1B visa for respective Fiscal Year.
